Conflict of interest lawyers DHS Genelle Franklin, Esquire with DHS Craig Straw, Esquire submitted 240 days late motion to dismiss and falsified the federal questions nature of suit and accurate causes of action of Plaintiff’s complaint by contextomy which continues to evade answering Plaintiff’s accurately stated causes of action in Complaint filed 09/10/09 and clearly stated in 10/16/2009 amended complaint “Plaintiff’s 09/10/09 Complaint is incorporated as if fully set forth herein” and  publicly evaded by Defendant Fern Brown Caplan 240 days by referring to an October 16, 2009 filing of Plaintiff who is without counsel, knowledge of federal rules of procedure and without any protection from court and lawyer malpractice counter intuitive legal procedures designed to ensnare Plaintiff forsaking truth finding in favor of falsification and contextomy.

Fern Brown Caplan maintains a private practice office listed in Philadelphia 2010 Legal Directory, 1515 Market Street, Philadelphia Pa 19103 and by an attorney referral service 522 Swede Street, Norristown, Pennsylvania.  Plaintiff asked by way of lawful filings for U.S.D.C. Honorable Mitchell S. Goldberg to compel the answers to Plaintiff’s 09/10/09 or enter default judgment in Plaintiff’s favor or in the alternative recuse U.S.D.C for the Eastern District of Pennsylvania pointing and showing evidence of U.S.D.C. for the Eastern District of Pennsylvania flagrant imposed administrative errors, docket discrimination which precluded fair and accurate adjudication of Plaintiff’s 09/10/2009 Complaint and has come to pass to cause the nearly one year irreparable injuries suffered by Plaintiffs Roxanne Grinage, Willie Brownson, Lorraine Grinage, Ezekiel Zadkiel Brown and Arriyel Roxanne Brown for which Federal Court has had all along exclusive jurisdiction to intervene enjoin official corruption fraud civil rights defendants in all related dockets stop ongoing irreparable harms suffered by Plaintiff, Plaintiff’s family, Plaintiff’s community development business enterprise, HireLyrics Administrative Services. 

DHS lawyer submitting private malpractice Fern Brown Caplan’s 240 days late motion to dismiss at City of Philadelphia and Commonwealth of Pennsylvania at U.S. taxpayers expense understandably falsifies by contextomy accurate causes of action which are not “dissatisfied with a custody decision” nor “plaintiff fails to state a cause of action…” but which are expressly stated in the case caption of the 10/16/09 Emergency filing of Plaintiff specifically to provide Honorable Mitchell S. Goldberg of proofs of Defendant Timothy Possenti’s forged documents which State Court Judge Robert J. Matthews used to inflict sua sponte bench warrant on Roxanne Grinage and Lorraine Grinage while we were trying to protect Plaintiffs Ezekiel Brown and Arriyel Brown from the willful reckless child endangerment inflicted upon them as a result of Fern Brown Caplan’s crimes committed with Timothy E. Possenti on August 14, 2009. 

At no time did Roxanne Grinage Willie Brownson Lorraine Grinage Ezekiel Zadkiel Brown and Arriyel Roxanne Brown ever rescind withdraw or alter the accurately stated and restated with evidence in all related dockets of causes of action in Plaintiff’s 09/10/09 Complaint.

Privately practicing professional bar association lawyer, Defendant Fern Brown Caplan is employed by First Judicial District Court of Common Pleas represented to the People of Philadelphia to be an impartial jurist for deciding custody matters in the best interest of children.  However, Defendant Fern Brown Caplan’s employer practices a malpractice systematic conflict of interest revenue relationship with State Agency DHS and budget crisis stressed needing the revenue generated by City of Philadelphia DHS Anne Marie Ambrose with F.J.D.C. child selling scheme Defendant in related 209cv05448-BMS.

DHS Genelle Franklin, Esquire is in no less than 92 dockets noted in U.S.D.C. for the Eastern District of Pennsylvania.   Of particular importance for a conflict check is the fact that in one docket in the U.S.D.C. for the Eastern District of Pennsylvania conflict of interest State Agency DHS lawyer Genelle Franklin becomes a defendant in an official corruption fraud civil rights complaint by a family victimized by corruption inflicted by F.J.D.C. with State Agency City of Philadelphia DHS.

[Plaintiff’s July 6, 2010 restated cause of action in this federal question:  Fern Brown Caplan is shown to have denied due process by destroying Plaintiff’s 47 pages with Exhibits A through H evidence in the best interest of children on August 14, 2009, when Fern Brown Caplan is heard saying on tape to Timothy Possenti, Esquire who was complaining that Plaintiff wrote two Supreme Court Justices about the Homeland Security Civil Unrest and U.S. Economy issues posed by lawyer malpractice with State Agency DHS court reform state of emergency, “I didn’t even bother reading it….”; and Fern Brown Caplan accepted the perjury testimony of CHOP social worker Patricia Lee, LSW who parroted Timothy E. Possenti’s client’s Erick Brown’s slander of Roxanne Grinage; and when Fern Brown Caplan presented herself as an impartial jurist who would make decisions based on the facts but accepted allowed the testimony of Erick Brown’s new girlfriend to override five years of proof Plaintiff Grandparents had that Erick Brown is violent towards his family and causes his family to be threatened by drug dealers he owes money to and that Plaintiffs Roxanne Grinage Willie Brownson and Lorraine Grinage were the ones providing consistent authentic nurturing care and education for Ezekiel and Arriyel Brown while their father was absent more than he was present.  Fern Brown Caplan heard Saundra Sullivan say she is receiving SSI for a plethora of disabilities that include the lower back and hearing disability.  Saundra O. On July 20, 2009 Plaintiffs Roxanne Grinage and Willie Brownson joined by Lorraine Grinage filed Custody Complaint against Erick L. Brown who had ripped Plaintiffs Ezekiel and Arriyel Brown from the only home authentic nurturing and education they ever knew and in with a strange new girlfriend Saundra O. Sullivan he met while illegally repairing cars on the street and her family who he knew less than thirty days and who he moved in with on July 5, 2009 after living with Plaintiffs for five years because Plaintiffs Roxanne Grinage and Lorraine Grinage confronted Erick L. Lorraine Grinage told Roxanne Grinage, plaintiff/grandparent that defendant father, Erick L. Brown saw the “Custody Master” on July 21, 2009, after filing Answers and Counterclaim in an attempt to “reverse” Acting Chief Custody Master, Michael Horan’s 07/20/06 Temporary Ex Parte Order Granting Relief asked for by Plaintiff Grandparents in 07/20/09, Emergency Petition for Relief.

On 24-JUL-09, Roxanne Grinage spoke to a staff member (a female), Clerk of Family Court Division by calling telephone number published at Court’s official website http://fjd.phila.gov/common-pleas/family/dr/; Clerk of the Family Court, Domestic Relations Division, 1133 Chestnut Street, Philadelphia, PA 19107, Telephone: (215) 686-3805, Fax: (215) 686-9308.  Roxanne Grinage asked whether any attorney had filed entry of appearance in this matter.  The staff member who answered the telephone in the Family Court Clerk’s Office, asked Roxanne Grinage for DR Number.  Roxanne Grinage gave staff member in Clerk’s Court’s assigned DR. No. OC0705124.  Roxanne Grinage did not think to ask for the name of the staff member and recall that it was a female’s voice.  Roxanne Grinage did not anticipate that we would be given contradictory information regarding service procedures within the CCP Family Court Division processes and did not think to ask for the name of the staff member. 

The staff member in the Clerk’s office confirmed by telephone on 24-JUL-09,  that (1) no attorney had entered his/her appearance on behalf of any party in the DR No. OC0705124, and (2) Clerk of Court docketed Codefendants’ 07/21/09 Answers and Counterclaims in response to Plaintiffs’ 07/20/09 Petition for Emergency Relief satisfied by Acting Chief Custody Master, Michael Horan’s, Temporary ExParte Order pending Rule Returnable 6-AUG-09 @ 1:30 pm in Room 280.   

Roxanne Grinage asked if Court’s Policy required Plaintiffs to receive service of Codefendants’ Answers and Counterclaims, by the Court as we had received service of Complaint and Notice of Custody Master’s Conference/Hearing 23-Nov-09 via first class mail.  Roxanne Grinage was told by the female staff member during 24-JULY-09 telephone conversation, that all parties would receive service of DEFENDANTS’ ANSWERS and COUNTERCLAIMS and NOTICE OF CONSOLIDATION by first class mail prior to the RULE TO SHOW CAUSE HEARING, RULE RETURNABLE, 6-AUG-09 @ 1:30 pm, before Acting Chief Custody Master, Michael Horan, Esquire, 46 S. 11th Street – Room 276, Philadelphia, PA   19107, Telephone: (215) 686-9292, Fax: (215) 686-2913.

On July 29, 2009, Roxanne Grinage called the Clerk’s Office again to ask questions (1) Can Amended Complaint be efiled – what is fee?; (2) Has any attorney entered an appearance in this DR No.?; (3) Title information for Michael Schoneitz, Esquire name given for presiding at Custody Master’s 23-NOV-09 and no information found at Family Court’s Phila.gov Directory regarding his Title or position within Family Court Division; and (4) Are exhibit proofs scanned into Family Court docket records as they are in other courts?; (5) Can we  look up docket for a custody matter online…If not, what do we have to do to get copy of Court’s docket report; and (6) Please check to see if service of Codefendants’ 07/21/09 Answers and Counterclaims may have been served/mailed to Plaintiff/Petitioner Grandparents at the wrong address. 

Roxanne Grinage asked these questions during 3 telephone calls in the order listed above.  Questions 1, 2, 3, 4 and 5 were answered and explained courteously and patiently in detail by a gentleman answering the Clerk’s office telephone on 29-JUL-09 at approximately 9:00 a.m.  This gentlemen gave Roxanne Grinage telephone number to Custody Master’s office to get title information for Michael Schoneitz and explained that Michael Schoneitz “is relatively new” and that is probably why I could not find his name in the phila.gov court’s published directory. 

Roxanne Grinage asked last question 6, about why Plaintiffs have not received service of defendant Erick L. Brown’s 07/21/09 Answers and Counterclaims to a young lady who answered Clerk’s Office phone approximately 9:20 a.m. on 07/29/09.  The staff member was courteous and explained that Plaintiff Grandparents should have received service by now, took the DR No. and asked Roxanne Grinage to hold on.  When the Family Court Clerk’s office staff member returned she explained that Defendant Erick Brown’s Answers and Counterclaims of “high level IRS Fraud” had been CONSOLIDATED and would be DISCUSSED within RULE TO SHOW CAUSE HEARING SCHEDULED 6-AUG-09.  The staff member in the Clerk’s office clarified that there would be no service to any party by mail.  I asked how Plaintiffs could prepare responses if we are not served?  The young lady stated “It will be discussed at that time”.

Fern Brown Caplan, Esquire is shown in Philadelphia Bar Association 2010 Legal Directory as maintaining a private practice office at 1515 Market Street, Philadelphia, Pennsylvania, 19103; and having a professional office at 522 Swede Street, Norristown, Pennsylvania, and shown by Pennsylvania Supreme Court disbarred and suspended attorneys list as having been reinstated after a suspension for failure to continue legal education and who is shown to be “associated” with First Judicial District Court of Common Pleas; and who works in Custody Masters Unit where she represents herself as an impartial jurist whose only concern is to weigh and consider all evidence in the best interest of children.

                Fern Brown Caplan, Esquire publicly avoided service of Honorable Mitchell S. Goldberg’s October 16, 2009 Order for U.S. Marshals to serve summons for 240 days.  At one point U.S.D.C. Clerk of Court entered into the docket a bogus summons returned unexecuted.  One summons made out to all defendants having separate addresses noted on Plaintiff’s 09/10/09 Complaint, with absolutely no address showing on the Bogus Summons to all Defendants and with a hand written service note:  “Spoke to Judge’s clerk no forwarding address available.”

                On December 14, 2009, summons evading Fern Brown Caplan, Esquire stood at the same place, her place employment where she abused her employment with F.J.D. CCP as a custody master on August 14, 2009 falsely representing herself to the People of Philadelphia County who petitioned F.J.D. Family Division for impartial fair and accurate adjudication of custody evidence in the best interest of children and where U.S.D.C. returned unexecuted bogus summons claimed she could not be located; and where Roxanne Grinage and Roxanne Grinage dba HireLyrics Administrative Services faxed her almost daily between 07/21/09 through 08/25/09 stating and restating exactly what Fern Brown Caplan, Esquire was doing to violate the following rights of Roxanne Grinage, Willie Brownson, Lorraine Grinage, Ezekiel Zadkiel Brown and Arriyel Roxanne Brown, stated in Plaintiff’s 09/10/09 Complaint.

On December 14, 2009, Philadelphia Orphan’s court records show that while Lorraine Grinage and Roxanne Grinage were falsely arrested and imprisoned by Judge Robert J. Matthews while seeking emergency petition for relief in custody master’s unit, Erick Brown and Saundra Sullivan were permitted by Philadelphia District Attorney Private Criminal Complaint to swear out false charges of terrorist threats against Lorraine Grinage and run over to City Hall and defraud Orphan’s court where they applied for fraudulent marriage licensed based on perjury divorce annulment Erick Brown got in Georgia by lying about his residency, lying about Lorraine Grinage’s residency, lying about the date of his marriage, lying about the existence of Ezekiel and Arriyel Brown and slandering and publicly defaming in Albany Herald Newspaper Lorraine Grinage who was in touch with Erick daily as we fought desperately to save Ezekiel Brown and Arriyel Brown from experiencing the horrors and injuries inflicted known to us starting December 13, 2009.

Possenti, Esquire, Pennsylvania Eastern District Clerk of Court, Philadelphia’s Office of Inspector General, Philadelphia’s District Attorney and Philadelphia’s Federal Bureau of Investigation. 

The 09/12/09 Letter is addressed to Supreme Court Justices Antonin Scalia, Stephen Breyer and President Obama warning of Homeland Security Civil Unrest issues bred in U.S. Citizens becoming increasingly frustrated seeing our children kidnapped for profit in conspiracy with racketeering and extortion of malpractice bar association attorneys and CPAs whose serial felony crimes are committed in partnership with an out of control bullying State Agency DHS; and aided and abetted by U.S.D.C. for the Eastern District of Pennsylvania’s Counter Intuitive flagrantly imposed Docket Discrimination which forsakes Judicial Oaths of impartiality and services the revenue needs of City of Philadelphia’s budget which depends on cash cow cash flow generated by State Agency DHS with F.J.D.C.
